ROSSA e QUARTIANI. -

Al Presidente del Consiglio dei ministri, al Ministro dell'interno.

- Per sapere - premesso che:

il corpo nazionale soccorso alpino e speleologico (C.N.S.A.S.) è una sezione particolare del C.A.I. costituita ai sensi dell'articolo 33 dello Statuto del C.A.I. ed a cui la legge of January 26, 1963, No 91 (Reorganization of the Italian Alpine Club) in Article 2, assigns the task to take 'appropriate technical initiatives for the prevention of accidents in the exercise of climbing and ii to the rescue of injured climbers and hikers or unsafe for any reason, and the recovery of remains of the fallen;

subsequent law of December 24, 1985, No 776 (New provisions in the Italian Alpine Club), Article 2, extending the scope of intervention for what concerned the "climbing activities, hiking and caving, to rescue the injured or unsafe and the recovery of the fallen, "specifying that" the Italian Alpine Club shall, with respect to both its members and other '

The law of 18 February 1992, no 162 (Measures for volunteers of the National Mountain Rescue Corps and the facilitation of its relief operations) were provided for volunteers of CNSAS engaged in training or in operations in case of emergency:

with the decree of Minister of Labour and Social Security of March 24, 1994, No 379 (Regulations for the volunteer Mountain Rescue), were established and laid down the detailed rules of Law 162 of 1992;

with the Law of 24 February 1992, n. 225 (imposition of National Service of Civil Protection), Article 11, letter l), the CNSAS is identified as "Operational structure of the national National Service of Civil Protection;

the decree of the President of Republic March 27, 1992 (Act of guidance and coordination to the region for the determination of levels of emergency medical care) states that "The health alert is provided by the operations center referred to by the single national telephone number 118;

provisions in the aforementioned decree of President of the Republic were expressly mentioned in the Law of 21 March 2001, n. 74, subsequently enacted, where article 2 provided that the operational structures of regional CNSAS are exclusive to regions subject to the implementation of medical aid in mountain areas and underground, and this reality is actually still operating only in areas where the national emergency telephone number only 118 has been activated and is fully operational which were also entered into special and specific agreements with the regional operating structures of CNSAS;

Law March 21 2001, No. 74 (Provisions to facilitate the work done by the Corps national Mountain Rescue), which further clarified and reorganized the rules concerning the CNSAS special:

a) Article 1, paragraph 1 has been recognized "the value of social solidarity and the role of the public utility service National Corp Soccorso Alpino e Speleologico (C.N.S.A.S.) del Club Alpino Italiano (C.A.I.)» cui «nel caso di intervento di squadre appartenenti a diverse organizzazioni, la funzione di coordinamento è assunta dal responsabile del C.N.S.A.S., e, nel confermare il riconoscimento di struttura operativa nazionale del Servizio nazionale della protezione civile, si è stabilito che il C.N.S.A.S. «concorre ai soccorso in caso di eventi calamitosi in cooperazione con le strutture di protezione civile nell'ambito delle proprie competenze tecniche ed istituzionali»;

b) all'articolo 2, nello stabilire che il C.N.S.A.S. «opera in stretto coordinamento con il Servizio NHS 'was expressly included in such regions "identified in the operating structures of regional and provincial CNSAS the subjects of exclusive reference to the implementation of emergency medical environment in mountain areas and underground," and that regions autonomous provinces "in the organization of emergency services and emergency care, conclude special agreements with the regional and provincial structures of the CNSAS"

la legge 27 dicembre 2002, n. 289 (Disposizioni per la formazione del bilancio annuale e pluriennale dello Stato), all'articolo 80, comma 39, ha ribadito come «il soccorso in montagna, in grotta, in ambienti ostili e impervi, è, di norma, attribuito al C.N.S.A.S.», e che always CNSAS "responsible for the coordination of emergency assistance in case of presence of other agencies or organizations, with the exception of major emergencies or disasters;

la convenzione di cui si avvale la regione Liguria, siglata il 13 novembre 2007 (convenzione triennale 2008-2010) ha instaurato un rapporto di collaborazione tra la regione Liguria, il comando regionale dei vigili del fuoco e il Ministero dell'interno, attraverso il prefetto, per il servizio pubblico di elisoccorso;

tale convenzione prevede che il servizio venga svolto in collaborazione tra il coordinamento dei servizi 118 liguri e il nucleo di elisoccorso dei vigili del fuoco , contemplando, altresì forme di rimborso spese per ore di volo effettivamente prestate in interventi di tipo «secondario»;

il servizio di elisoccorso in base alla normativa dell'Enac è assimilabile al servizio trasporto passeggeri e per garantire la sicurezza di medici, infermieri e pazienti a bordo chi cura elisoccorso deve avere un certificato di operatore aereo rilasciato dall'Enac, e il reparto volo del Corpo dei vigili the fire does not have it;

la sentenza del Consiglio di Stato of July 13, 2010 allowed the appeal on the failure characteristics of helicopter service imposed by Regulation (EEC) No 3922/91 and the provisions referred to in the Agreement State-Region in 2005 (Civil Aviation Regulation or a March 2004 and move application of the ENAC OPV 18 May 26, 2004);

la convenzione della regione Liguria è in scadenza nel mese di maggio 2011 -:
